Does booking through Quarterdeck make the Staff Member my employee?

Booking through Quarterdeck does not, by itself, make the Staff Member your employee. Quarterdeck acts as a booking, placement, coordination, and invoicing intermediary unless it expressly agrees otherwise in writing.

What is Quarterdeck’s role?

Quarterdeck’s role may include sourcing, screening, matching, coordinating, invoicing, payment administration, and managing the booking process. That does not mean Quarterdeck is making the Staff Member your employee, agent, or representative unless that has been expressly confirmed in writing.

What is the Staff Member’s status then?

The legal and working status of a Staff Member can vary depending on the role, location, duration, compliance requirements, and booking structure.

A Staff Member may be engaged as:

  • an independent contractor

  • a consultant

  • a freelancer

  • a worker

  • an employee

  • or under another assignment-specific structure

Could there still be a separate legal relationship?

Yes. In some cases, a separate legal relationship may exist between you and the Staff Member if that is expressly agreed in writing or arises under the assignment structure, local law, or another separate agreement.

Does this create an employment relationship with Quarterdeck?

No. The Staff Booking Terms say that nothing in those terms creates an employment relationship, worker relationship, partnership, joint venture, or agency relationship between you and Quarterdeck.

Can I assume I can hire the person directly later?

No. Nothing in the Staff Booking Terms gives you any right to employ, directly engage, or otherwise retain a Staff Member outside Quarterdeck unless Quarterdeck has expressly agreed to that in writing.
